Employee discrimination claims can be a costly problem for small business owners. Legal settlements can average between $27,000 and $54,000, according to HSB insurance data. Even if a business owner prevails, the legal defense still costs around $10,000 on average.

Disability law covers many scenarios

Many different scenarios could trigger a disability discrimination claim against a small business owner. These include complaints about discrimination in hiring and firing, as well as failure to make reasonable accommodations for a worker with a disability.

Claims broke records last year

Employment claims for disability discrimination are a growing source of risk for small business owners. 2015 was a record year for disability discrimination claims: the Equal Employment Opportunity Commission (EEOC) received more disability claims than ever (26,968). The agency settled the most claims ever (2,941), and recorded the highest-ever total for compensation for disability claims ($128.7 million).

There are ways to protect your business

Small-business owners can take steps now to reduce the chances of an employee filing a disability discrimination claim. Every business should actively train managers and workers in proper employment policies, and keep up with changes and updates to laws and employment regulations.

The right coverage is critical

Every small business should be covered with employment practices liability (EPL) insurance, which protects a business in the event of a disability discrimination claim. HSB's Portfolio Employment Practices Liability coverage is a turnkey program that insurers can add to their business owner policies, commercial packages, or workers’ comp policies.

An employee complaint can be costly

“Without EPL coverage, small business owners face the very real risk of having to pay a discrimination claim out of their own pockets,” said Todd Cincotta, vice president of strategic products for Hartford Steam Boiler.
